Questions about the Employment Contract

The position, duties, work location and schedule, whether employment is at will or for a fixed term, salary or hourly pay and how often it is paid, any bonus or commission, benefits and paid time off, business expenses, confidentiality, ownership of work product, and how the employment ends. Both the employer and the employee sign it.

An offer letter invites a candidate to accept a job on stated terms. An employment contract is a fuller agreement both sides sign, with terms on confidential information, inventions, ending the employment and, if you choose, a fixed term with notice and cause provisions.

Yes. At-will employment can be ended by either side at any time, unless applicable law provides otherwise. A fixed term runs to an end date and can be ended early for cause, or by either side on the notice you choose.

No. This contract does not include one. You can include a narrower promise not to recruit the employer's employees, which applies only to the extent permitted by applicable law.
