What this document does

A stand-alone agreement between the owner of tools, machinery, audio-visual gear, cameras, trailers, generators, or other general equipment and the person or business renting it for a set period, covering an inventory of up to five items with their condition and replacement value, the rental period and rate, pickup or delivery, use and care, damage, loss, theft, an optional damage waiver, late return, the deposit and payment, breakdown, and cancellation. It is not for vehicles driven on public roads, and it is not a lease with an option to buy: the owner keeps title to the equipment throughout.

Questions about the Equipment Rental Agreement

An inventory of up to five items with their make, model, serial number, condition at handover, and replacement value; the rental period and the rate per day, week, or month or a flat charge; pickup or delivery; how the equipment must be used and cared for; who pays for damage, loss, or theft; late return; the deposit and payment terms; breakdowns; and cancellation.

General equipment such as tools, construction and landscaping machinery, generators, cameras and audio-visual gear, event equipment, and trailers. It is not written for cars, trucks, or other vehicles driven on public roads, and it is not a rent-to-own or lease-purchase arrangement.

You choose a rate per day, per week, or per month, or one flat charge for the whole period. For a daily rate the agreement counts the days between the start and end dates and states the total. You can also set a minimum charge, a late charge for each overdue day, and whether payment is made in advance or on invoice.

The renter is responsible from handover until return, pays the repair cost up to the item's replacement value, or the replacement value if the item is lost, stolen, or beyond repair, and must report a theft to the police within 48 hours. Normal wear is excluded. You can offer a damage waiver for a fee and require the renter to carry insurance for a stated amount.

After a grace period you set, a late charge applies for each day or part of a day. After a stated number of days overdue, the owner may treat the equipment as lost and claim the replacement value, while keeping the right to recover the equipment itself.
