What this document does

A stand-alone agreement between the host of a furnished home, apartment, cabin, or private room and a guest staying for a few nights to a few weeks, covering the property and its amenities, check-in and check-out, the registered guests and maximum occupancy, house rules on noise, smoking, pets, and parking, the nightly charges and payment schedule, a security deposit or damage waiver, cancellation terms, and responsibility for damage. It is a short-term license to occupy, not a residential lease, and it does not cover a tenant who will live at the property month after month.

Questions about the Vacation Rental Agreement

The property and its amenities, the check-in and check-out dates and times, who may stay and the maximum occupancy, house rules on noise, parties, smoking, pets, parking, and any pool or hot tub, the nightly rate and other charges with a payment schedule, a security deposit or damage waiver, cancellation terms for both sides, how the guest gets in and checks out, and who pays for damage or an overstay.

No. The agreement is written as a short-term license to occupy for a vacation or other short visit, with a set check-in and check-out. It says that the guest acquires no tenancy rights to the extent applicable law permits, and it is not the right document for someone who will live at the property month after month.

You enter a nightly rate, and the agreement multiplies it by the number of nights between the dates you choose. Any cleaning fee, pet fee, extra guest fee, taxes at a percentage you enter, and a damage waiver fee are added in an itemized table with the total. You then choose whether the guest pays a percentage or fixed amount at booking with the balance due before check-in, or the whole total at booking.

Yes. Choose a refundable security deposit, and the agreement sets when it is due, what may be deducted, and the number of days for returning it with an itemized list. You can instead charge a non-refundable damage waiver fee that covers reported accidental damage up to a limit, or take no deposit and simply bill the guest for damage.

You set two deadlines and a percentage. A cancellation before the first deadline gets a full refund, or a refund less a booking fee percentage you choose; a cancellation between the deadlines gets the percentage you set; a later cancellation gets nothing back. If the host cancels, the guest gets everything back and reasonable help finding another place, and no refund is due for a late arrival or an early departure.

No. It states how the guest gets in, whether keys in person, a lockbox, or a smart lock, and says that the host sends the access instructions separately before check-in. Codes never appear in the document.
