Durable Financial Power of Attorney

Answer a few questions to create a professional Durable Financial Power of Attorney, ready to edit and sign.

Step 1 of 1211 sections · answer each, then create your document

Where you will sign

The signing rules (witnesses, notary, required wording) depend on the state. LeaseCraft prepares this document only where it has verified those rules at the official source; for other states it tells you so.

The document is prepared for that state's signing rules and is interpreted under its laws. If you live in one state and will sign in another, or own real estate in several states, talk to a lawyer.

You (the Principal)

The Principal is the person giving the power - you.

Use the name exactly as it appears on a government-issued ID, including any middle name or suffix.
The county where this address is. Leave blank if you are not sure.

A few facts about you

Only an adult who understands what the document does should sign it. If someone is pressuring you, do not sign.
Some states add rules when the Principal lives in a care facility; the checklist shown with your document says whether your state has them.

Your agent

Your agent (also called your attorney-in-fact) acts for you with the powers you give. Choose an adult you trust completely.

Use the name exactly as it appears on a government-issued ID, including any middle name or suffix.
The county where this address is. Leave blank if you are not sure.

More than one agent?

Co-agents who must act jointly both have to agree and sign for every action, which is safer but slower. Co-agents who may act independently can each act alone.
A successor agent takes over if your agent (and any co-agent) dies, resigns or can no longer act.

When it takes effect

"Immediately" means your agent can act as soon as you sign, and the document keeps working if you later become incapacitated. "Only if I become incapacitated" (a springing power) starts only after a physician certifies your incapacity in writing; some states' springing rules are not yet verified by LeaseCraft, and there the document is prepared only with "Immediately".

Powers you give

Choose every area your agent may act in. Anything you do not choose is not granted. Health-care decisions are not part of this document.

Special powers (need your initials)

These powers can change who receives your property. Each one you grant is listed separately in the document with a line for your initials; initial each one by hand when you sign. Anything you do not grant here is expressly withheld.

Compensation and prior documents

Either way, your agent is reimbursed for reasonable expenses paid on your behalf.
Choose yes to cancel earlier financial powers of attorney. A health-care power of attorney is not affected either way. Tell anyone who holds an earlier power of attorney that it has been revoked.
Limits on what your agent may do. Do not use this box to add powers; for anything complex, talk to a lawyer.
