Answer a few questions to create a professional Marketing Services Agreement, ready to edit and sign.

Step 1 of 1211 sections · answer each, then create your document

The marketing agency or freelancer

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices under the agreement.

The client

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices under the agreement.

The marketing work

Start with a verb, for example "increase online bookings for its dental practice" or "launch its new product line."
Work in channels you do not select is not included unless both sides agree to it in writing.
List the specific work, one item per line, for example "manage Google Ads campaigns" or "write and schedule 12 social posts per month."
Items the agency will hand over, such as a brand style guide, a website audit, or a set of ad designs, one per line. Leave blank for ongoing work with no fixed list.

Content approval

Ads, posts, emails, press releases and web pages are sent to the client for approval first.
Choosing "no" means nothing is published without the client's approval, which can delay campaigns. If the client's business has special advertising rules, content subject to those rules always needs the client's actual approval.

Advertising spend

Ad spend is the money paid to platforms such as Google or Meta for ads, separate from the agency's own fees.

Reporting

For example, "website traffic, leads, cost per lead, and email open rates."

Accounts and access

Either way, the client owns its accounts and the data in them.

Term

Leave blank if the work continues until either side ends it.

Fees and payment

The monthly retainer, the total project fee, or the hourly rate, depending on your answer above. Ad spend is not included.
Enter 0 if payment is due on receipt.
This does not cover ad spend, which is handled above.

Creative work and compliance

For example health products, financial services, alcohol, or anything that needs required disclaimers. If yes, the client is responsible for telling the agency what those rules require.

Final terms

Usually the state where the agency or the client is based.
