Model and Talent Services Agreement

Answer a few questions to create a professional Model and Talent Services Agreement, ready to edit and sign.

Step 1 of 1413 sections · answer each, then create your document

The talent

The model, actor, voice artist, or other performer being booked. If the talent works through their own company, enter the company as a business.

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices under the agreement.

The client

The photographer, brand, producer, or agency booking the talent and paying the fee.

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices under the agreement.

Age and representation

If yes, a parent or legal guardian is added as a party who signs the agreement and confirms their authority. Additional rules may apply to a minor's work, such as work permits, limits on hours, a set teacher or chaperone, and paying part of the earnings into a trust or blocked account. This agreement does not replace those requirements; check what applies where the engagement takes place before you book.
The agency is named in the agreement but does not sign it. Its commission stays a matter between the talent and the agency.

The parent or guardian

The parent or legal guardian who signs for the talent and confirms their authority to do so.

The engagement

One or two sentences on what the day is for, for example "an e-commerce shoot of the autumn knitwear range, about 40 garments."
If there is no formal name, describe it briefly, for example "spring lookbook" or "radio spot for the Riverside dealership."
Fill this in only if the engagement runs over more than one day.
For a multi-day engagement, give the usual times; a call sheet can vary them.
The studio, venue, or address. End with the city, state, and ZIP code, for example "Studio B, 410 Congress Avenue, Austin, TX 78701." If there is more than one, list them separated by semicolons.
Counted from the call time, including hair, makeup, and wardrobe. Any overtime rate applies beyond this.

What the talent will do

The looks, scenes, poses, lines, product handling, or appearances expected. Be specific; anything not described is outside the booking.
Start with "a", for example "a one-hour fitting at the studio on the day before the shoot" or "a two-hour rehearsal on the morning of the show." Leave blank if there is none.

Content limits

Nudity and partial nudity are always excluded unless the talent signs a separate consent. Add anything else that is off-limits here.

For example "no swimwear, no smoking or vaping on camera, no images with religious symbols, no work with live animals."
Leave every box unchecked to exclude all of them. Political, adult, tobacco or vaping, alcohol, gambling, firearms, and pharmaceutical uses are excluded unless you check them here.

Fees and payment

Leave blank if extra time is priced case by case. Overtime usually runs at or above the normal hourly equivalent.
A separate fee for the permission to use the talent's image, in addition to the session fee. Leave blank if the session fee covers everything.
Leave every box unchecked if the talent covers their own costs of attending.

Cancellation

Cancelling with less notice costs the percentage below; cancelling within 24 hours or on the day costs the full session fee.
Applies when the client cancels with less than the notice above but more than 24 hours before. 50 is common.
For outdoor shoots and events. The client may postpone once because of weather and rebook within 30 days.

Permission to use the talent's image

This section is a release. The talent gives up claims about the uses chosen here, so read it carefully: the purposes, territory, and length of the permission decide what the client may do with the photographs, video, audio, and likeness, and for how long.

Choose every purpose the talent agrees to. Anything not chosen requires a new agreement.
Leave blank if no credit is expected. For example "Model: Ana Reyes" or the talent's social media handle.
"No" means the talent waives the right to inspect or approve the finished images and how they are used, within the limits of the agreement.

Insurance

Anything else

For example, a parking arrangement, a chaperone, a promise of a set of retouched images for the talent, or a social media posting schedule.

Governing law

Usually the state where the engagement takes place.
