Roommate Release Agreement

Answer a few questions to create a professional Roommate Release Agreement, ready to edit and sign.

Step 1 of 1413 sections · answer each, then create your document

The landlord

The owner or property manager named as landlord on the lease.

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices.

The roommate who is leaving

The tenant being released from the lease. Their current address is the rental itself; a forwarding address is asked for later.

The roommate who is staying

The tenant who stays on the lease and takes over the departing roommate's responsibilities.

Other remaining tenants

Answer yes if two roommates stay behind. Both remaining tenants sign, and both are responsible for the lease from the release date.

The second roommate who is staying

The lease

Include the unit number, city, state, and ZIP code, as it appears on the lease.
The date shown on the lease, or on the latest renewal that the departing roommate signed.
The full rent for the whole unit, not one roommate's share.

The release

The "Release Date". From this date the departing roommate owes nothing further under the lease and gives up the right to live there. It is usually the end of a rent period.
Answer no for the usual arrangement: the departing roommate remains responsible for unpaid rent and for damage caused during their stay. Answer yes for a full release, where the landlord looks only to the remaining roommate or roommates for those earlier obligations.

Moving out

Leave blank if the departing roommate moves out on the Release Date. An earlier date does not shorten their responsibility under the lease, which ends on the Release Date.
Where notices, any deposit refund, and mail should be sent after move-out. Include the city, state, and ZIP code.
Counted from the move-out date. The agreement says this cannot shorten any waiting period that the law requires.
A joint inspection records any damage and who caused it. Answer no if the landlord will inspect later on its own.

The security deposit

Choose "no deposit" if the landlord holds no deposit under the lease.

Final rent and shared bills

Enter the prorated share the three of you agreed, or choose no rent if the remaining roommate covers that whole month.
Electricity, gas, water, internet, and similar bills for the time up to move-out. Choose a date on or after the Release Date, when the last bills are likely to have arrived.
Adds a clause that the readings taken that day are the basis for splitting the last utility bills.

The landlord's consent

Each condition you select must be met by the Release Date, or the release does not take effect and the lease continues unchanged unless the landlord waives the condition in writing. Leave all unselected for an unconditional consent.
Adds a clause that the replacement must apply to the landlord and be added by a separate agreement, and that the remaining roommate carries the full rent until then.

Optional terms

Adds a clause that the guarantor is not released by this agreement and that the landlord obtains the guarantor's written consent separately.
Adds a mutual release between the departing and remaining roommates covering rent, bills, shared belongings, and the condition of the rental, apart from what this agreement itself requires. It does not affect the landlord.
For example, who keeps the couch, or a payment plan for an amount owed. Write it as you want it to appear in the agreement.

Governing law

That state's law governs this agreement. It must match the state in the rental's address.
