Storage Space Rental Agreement

Answer a few questions to create a professional Storage Space Rental Agreement, ready to edit and sign.

Step 1 of 1211 sections · answer each, then create your document

The owner of the space

The person or business renting out the storage space.

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices.

The renter

The person or business that will store property there.

For a business, use its registered name, including "LLC" or "Inc." if it has one.
Used for written notices.

The storage space

Include the city, state, and ZIP code. For a shed, room, or garage at a home, use the home's address.
Enough to tell the space apart from any other at the address, such as "Unit B-12," "the north half of the basement," or "the container behind the barn."
For example, "10 by 10 feet (about 100 square feet)" or "a 20-foot container." The agreement prints it after the word "approximately," so there is no need to write "about." Leave blank to describe the space by its identifier only.
Answer yes only if the space is heated and cooled to keep temperature and humidity within a moderate range. An ordinary shed, garage, or container is not.
Usual for a self-storage unit or container. Answer no if the owner provides the lock and gives the renter a key or combination.

What may be stored

Select everything that applies. Anything not selected here needs the owner's written consent, and the agreement always prohibits hazardous materials, perishables, animals, plants, and illegal property.
The most the stored property may be worth in total. The owner does not accept property above this amount, and it caps any claim against the owner as far as the law allows. The renter should insure the property up to this amount.

Access

This is about getting into the facility, building, or yard, not the lock on the space itself.
For example, "Use the covered loading bay by the office; vehicles may stay in the bay for up to 30 minutes." Leave blank for the agreement's general rule that loading areas are used only while actively loading or unloading.

Rental period

The first day the renter may use the space. The first rent payment and any deposit or set-up fee are due on or before this day.
For an ongoing rental, either side may end it with this much notice. For a fixed term, the same notice applies once the rental continues after the end date.

Rent, fees, and deposit

The amount for one rent period, before any late fee.
A flat amount charged once for each rent payment that is late. Leave blank for no late fee.
A fee paid once, before the start date, for setting up the rental. It is not refundable. Leave blank if there is none.
Leave blank if no deposit is collected. A deposit is returned at the end, less any deductions the agreement allows.

Rules, entry, and insurance

For example, "no more than 100 pounds per square foot" or "no single item over 500 pounds." Leave blank if there is no specific limit.
The owner may still enter at any time in an emergency, and may remove prohibited items.
Either way, the owner does not insure the renter's property and is not responsible for it except for the owner's own negligence. Answering yes requires the renter to keep insurance and show proof of it.

Default and moving out

Once rent is this many days late, the owner may deny the renter access to the space until everything owed is paid.
Leave blank to charge the rent prorated by the day instead of a set daily amount.
After this many days the owner may remove and dispose of what is left, as far as the law allows and after any notice the law requires.

Anything else

For example, use of the facility's carts or dollies, or a rule about pest control. Write it as you want it to appear in the agreement.

Governing law

Usually the state where the storage space is.
