Questions about the Bill of Sale

The seller and buyer, a description of the item (and for a vehicle, its year, make, model, VIN, and the odometer reading as the seller states it), the price and how it is paid, when ownership passes, the item's condition, any liens, delivery, who bears the risk of loss before delivery, and who pays taxes and fees. Both sides sign it.

The buyer takes the item in its current condition and, to the extent the law allows, the seller makes no promises about how it works or how long it will last. The seller still promises that it owns the item and can sell it. If you prefer, the seller can instead list the defects it knows about and state that, to its knowledge, the item has no other significant defects.

Yes. For a vehicle it records the year, make, model, VIN, and a short seller's statement about the odometer reading. The agency that titles and registers vehicles, boats, or trailers where the buyer lives may have its own title transfer or bill of sale form and may ask for the signed title or other paperwork in addition to this document. Check with that agency before the sale.

Say so in the questionnaire. The bill of sale describes the loan or lien and records that the seller will pay it off before or at the transfer and give the buyer proof that it has been released.
