What this document does

A stand-alone agreement between the owner of a parking space in a garage, lot, driveway, or carport and the person or business renting it, covering the space and whether it is assigned, the permitted vehicles, access hours and any gate code, remote, or key, rent, late fees and a security deposit, a fixed or ongoing term, parking rules, towing, and responsibility for damage. It is not a lease of a home or business premises, and it does not add parking to an existing lease; the parking addendum does that.

Questions about the Parking Space Rental Agreement

Which space is rented and where, whether it is assigned or any available space, which vehicles may use it, when the renter can get in and what code, remote, or key is needed, the rent, due date, late fee and any deposit, how long the rental runs, the parking rules, towing, and who is responsible for damage.

No. This is a stand-alone agreement between the owner of a space and a renter who has no other lease with the owner. If you want to add parking to an existing residential lease, use a parking addendum instead so the parking terms become part of that lease.

Either. An ongoing rental continues month-to-month, week-to-week, or year-to-year until either side gives the notice you choose. A fixed term has an end date, and you decide whether the renter may leave early with notice, with notice and a fee, or not at all.

Up to two vehicles can be listed by make, model, and license plate, with only one in the space at a time. You can also set size limits and say whether commercial vehicles, trailers, boats, or RVs are allowed; if you do not, the agreement limits the space to ordinary passenger vehicles.

The agreement treats a vehicle that is not permitted, or one left after the rental ends, as an unauthorized vehicle. You choose whether the owner may have it towed at the vehicle owner's expense, to the extent the law allows, or will give written notice first except in an emergency.
