What this document does

A stand-alone agreement between a private owner or a small storage facility and the person or business renting a storage unit, room, shed, shipping container, garage bay, or area of floor space, covering the space and its lock, what may and may not be stored, a declared value limit, access hours and entry, rent, fees and a deposit, a fixed or ongoing term, insurance and the owner's limited liability, the rules, default, and moving out. It is not a warehouse services or bailment agreement, because the owner does not take custody of the goods, and it does not set out any lien-sale procedure, which differs by state.

Questions about the Storage Space Rental Agreement

Which space is rented and where, its approximate size and whether it is climate controlled, who supplies the lock and whether the owner holds a key, what may and may not be stored, a declared value limit, access hours and how the renter gets in, the rent, due date, late fee, set-up fee and deposit, how long the rental runs, insurance, the owner's limited liability, the rules, what happens if rent is not paid, and moving out.

No. Under this agreement the owner rents space and does not take custody or control of the stored property. A warehouse services or bailment arrangement, where the operator receives goods, issues a receipt, and is responsible for keeping them, needs a different document.

After the number of days you choose, the owner may deny access to the space until everything owed is paid, may end the agreement, and may pursue whatever remedies the law allows. Self-storage lien and sale rules differ from state to state, and this agreement does not set out a lien-sale procedure; an owner who wants to sell stored property must follow the notice and sale steps that apply where the space is.

The renter. The agreement says the owner does not insure the property and is not responsible for theft, weather, water, pests, or fire except for the owner's own negligence or willful misconduct, and it caps any claim at the declared value limit as far as the law allows. You choose whether the renter must carry insurance and show proof of it.

Either. An ongoing rental continues month-to-month or week-to-week until either side gives the notice you choose, and the owner may change the rent for future periods with notice. A fixed term has an end date and continues period to period afterwards if the property stays and the owner accepts rent.
