Basic Habitability Standards
Every rental must meet minimum habitability standards to be legally rented.
- Weatherproof roof, walls, windows, and doors
- Working plumbing and hot/cold running water
- Functional heating (and AC in some states)
- Working electrical systems and adequate lighting
- Safe and working smoke/CO detectors
Health and Safety Requirements
Properties must be free from conditions that endanger tenant health.
- No serious mold or water damage
- No pest infestations (roaches, rodents, bedbugs)
- Lead paint disclosure and remediation
- Proper ventilation and air quality
- Secure locks on doors and windows
Landlord Repair Obligations
Landlords must make repairs in reasonable time when habitability is affected.
- Emergency repairs: 24 hours (no heat/water)
- Major repairs: 3-14 days depending on state
- Must respond to tenant repair requests
- Cannot retaliate for complaints
