When to use something else

Frequently asked questions

Most leases address subletting directly, and many require written consent. Check your lease before you advertise — subletting in breach of it can put your own tenancy at risk. The generator asks you to record the consent position.

No, and this is the most common misunderstanding. Under a sublease the original tenant normally stays liable to the landlord for rent and for damage. If the subtenant stops paying, the landlord still looks to you.

A sublease creates a new relationship underneath your lease, which continues. An assignment transfers your lease to someone else and takes you out of it. They have very different consequences for who owes the rent.

It should not. A sublease cannot grant more than the original tenant has, so the end date should fall on or before the master lease end date. The generator asks for the master lease end date so the two documents stay consistent.

Usually the original tenant, who is also responsible for returning it. That is a second deposit obligation on top of the one the landlord holds from you — worth being deliberate about before taking money.
