The notice periods Idaho law sets before a landlord can file for eviction, as LeaseCraft read them in the statute, with the conditions and exceptions that go with each. The guided form prepares a pay-or-quit, cure-or-quit, unconditional-quit, no-cause or holdover notice with Idaho already selected.

Idaho notice periods

Each period is the one LeaseCraft's record of the statute holds. Read it with the conditions under it: some periods are minimums and some apply unless the lease sets another. "Lease controls" means the record holds no statutory period for that situation, and "No pre-suit notice" means it holds no notice before filing. The source column shows the law and the date LeaseCraft read it on the official site (most recently 2026-09-27).

What the Idaho statute says

Unpaid rent: 3 calendar days

  • Tenant continues in possession after default in rent AND after three days' written notice requiring payment (stating the amount due) or possession has been served (Idaho Code 6-303(2)).
  • Notice served per Idaho Code 6-304 (personal; substitute + mail; post + deliver to resident + mail).

Lease violation: 3 calendar days

  • Neglect or failure to perform other lease conditions or covenants: three days' written notice requiring performance or possession (Idaho Code 6-303(3)).

Exceptions

  • If the covenants 'cannot afterward be performed', no notice need be given (6-303(3)).

Ending the tenancy without a chance to cure: 3 calendar days

  • Assigning or subletting, or committing waste, contrary to the lease covenants terminates the lease; landlord entitled to restitution upon service of three days' notice to quit (6-303(4)).
  • Unlawful delivery, production or use of a controlled substance on the premises during the term is unlawful detainer under 6-303(5); that subsection states no notice period (expedited proceedings under Idaho Code 6-310 — not read).

Ending a month-to-month tenancy: 30 calendar days

  • STATUTE SAYS 'not less than one (1) month' (not 30 days) — a full calendar month is the safe reading; landlord's written notice must specify the removal date (Idaho Code 55-208(1)).
  • Tenant likewise must give not less than one month (55-208(2)).
  • Notice given 'in the manner' prescribed by the code of civil procedure (i.e., 6-304).

Tenant staying after the lease ends: No pre-suit notice

  • Continuing in possession after expiration of the term without the landlord's permission is unlawful detainer with no notice required (6-303(1)).

Preparing the notice

The form asks for the tenancy, the kind of notice and the dates, and the notice ends with a Certificate of Service to record how you delivered it. Beside the finished notice you get a Idaho checklist of the period, form and delivery rules LeaseCraft recorded. The period in the notice is the one you choose; where LeaseCraft has verified the Idaho period and your deadline is too soon, the document is not prepared until you move it.

A notice is not a court order and does not by itself remove a tenant. Cities and counties can add rules. LeaseCraft is not a law firm and this is not legal advice.
