What an Abandonment Notice is

An abandonment notice tells a tenant that the landlord believes they have left the rental for good. It states the facts behind that belief - the date rent was last paid and roughly how long the unit has been vacant - and asks the tenant to contact the landlord in writing right away if they have not abandoned it.

If personal property was left behind, the notice describes it, says where and when it can be claimed, and gives the deadline to reclaim it. It reserves the landlord's rights under the lease and states that the landlord will not retake possession or dispose of the property except as the law allows. The notice records how it was delivered.

Abandonment rules are strict and differ widely by state: some require a specific notice, waiting period or storage before belongings can be removed, and some require a court process to recover possession. Check your state's rules before relying on this notice.

When to use it

  • Rent is unpaid and the unit appears to have been vacant for some time.
  • The tenant left belongings behind and you need to say how to claim them.
  • You want a written record that you tried to reach the tenant.
  • You need a dated notice before deciding on next steps under your state's rules.

You will need answers to these 11 required questions, spread over 3 steps. The questionnaire also has optional questions, and some answers lead to follow-ups. Your answers are kept in this browser for 24 hours, so you can come back and finish (how saving works).
