What a Lease Extension Agreement is

A lease extension agreement keeps an existing lease going past its end date without signing a new lease. It identifies the original lease, states when the current term ends, and sets the start and end dates of the extension term.

It states the monthly rent for the extension and, if the rent changes, the old and new amounts and the date the new rent starts; until then the existing lease and its rent continue. Every other term of the lease is ratified, and any security deposit continues to be held on the same terms. Where the wizard's answers call for it, the agreement adds notes about disclosures that may apply to the extension, such as the federal lead-based paint disclosure for housing built before 1978. That disclosure need not be given again when the landlord already gave it in full for the current lease and has no new information (40 CFR 745.101(d)).

Landlord and tenant both sign. If the tenant is staying but other terms are changing too, a lease renewal agreement or a new lease may fit better.

When to use it

  • The lease ends soon and both sides want the tenant to stay for a set period.
  • You are extending the term and changing only the rent.
  • You want to avoid sliding into a month-to-month tenancy by default.
  • You want the deposit to carry over on the same terms.

What to have ready

You will need answers to these 10 required questions, spread over 3 steps. The questionnaire also has optional questions, and some answers lead to follow-ups. Your answers are kept in this browser for 24 hours, so you can come back and finish (how saving works).

  1. Landlord & tenant
    • Who is the landlord?
    • Who is the tenant?
    • What is the rental property address?
    • Date of the original lease being extended?
  2. Extension terms
    • When does the current lease end?
    • What is the new lease end date?
    • What is the monthly rent for the extension period?
    • When does this extension agreement take effect?
  3. State
    • Which state is this document for?
    • Was the home built before 1978? (lead-paint disclosure)

Why build it from your answers?

A blank form leaves you to work out what belongs on each line. The wizard asks for the facts your Lease Extension Agreement needs, builds the document from your answers, and lets you check the preview before you unlock the editable Word and PDF files. The preview is free, and the files come with a LeaseCraft membership ($2.99/month or $19.99/year).

Frequently asked questions

Quick answers about this document type.

  • An extension keeps the current lease and moves its end date. A renewal usually starts a new term and may restate or change more terms. Use an extension when only the dates and rent change.
  • Yes, if the tenant agrees to the extension at that rent. The agreement records the current and new rent and the date the new rent starts. Some cities limit increases, so check local rules.
  • It stays in place. The agreement states that any deposit held under the existing lease continues to be held on the same terms during the extension.
