What a Lease Guarantee (Guarantor Agreement) is

A lease guarantee, also called a guarantor agreement, is a promise by a third party - often a parent or relative - to pay the tenant's rent and other lease obligations if the tenant does not. Landlords ask for one when a tenant has limited rental history, income or credit.

The agreement LeaseCraft builds identifies the guarantor, the landlord, the tenant, the property and the lease term, and states the monthly rent. It sets out what the guarantee covers, whether it is capped, how many days the guarantor has to pay after the landlord's written demand, and the guaranteed period: this lease term only, or renewals, extensions and holdover too. A guarantee for this term only does not cover a renewal unless the guarantor agrees in a signed writing.

The guarantor signs, and the landlord signs to accept the guarantee. Because the guarantor takes on personal liability, they should read the lease they are guaranteeing before they sign.

When to use it

  • A student or first-time renter needs a parent or relative to back the lease.
  • An applicant's income or credit falls short of your screening criteria.
  • You want the guarantor's obligations, period and any cap in one signed document.
  • You want it clear whether renewals and extensions are covered.

What to have ready

You will need answers to these 13 required questions, spread over 3 steps. The questionnaire also has optional questions, and some answers lead to follow-ups. Your answers are kept in this browser for 24 hours, so you can come back and finish (how saving works).

    • Does the guarantee also cover renewals, extensions and holdover?
    • When must the guarantor pay after the landlord demands payment in writing?
    • Guarantor acknowledges personal liability if tenant defaults?
    • Effective date?
    • Which state is this document for?
